关于新冠疫情影响的索赔通知格式（中英对照）

几天前，出于非常时期做点公益的目的，起草了一份《关于新冠病毒疫情事件的不可抗力通知格式（中英对照）》供我国“走出去”企业参考使用，这几天有企业向我反馈，已根据我提供的不可抗力通知格式起草了不可抗力通知发给了业主，但对于后续怎么起草一份有礼有节的索赔通知没有把握，问我能否提供一份索赔通知格式参考借鉴。为此，昨夜专门为大家起草了下面这份不可抗力索赔通知格式，供大家参考使用，希望对我国“走出去”企业能有所帮助。

需说明的是，这份通知格式是针对海外工程项目起草的，如果国内工程项目上参考使用，需要对其行文措辞进行相应调整修改。

尊敬的先生/女士：

Dear Sir/Madam,

贵司已知悉，中国于2020年【】月【】日爆发了新型冠状病毒流行病（以下简称“2019新冠疫情”）并已蔓延至全国范围，且已于2020年1月30日被世界卫生组织认定为国际关注的突发公共卫生事件，这已实质影响了我们对【填写项目全称】（以下简称“本项目”）的执行，因为我们为本项目执行所需的【】设备材料是从中国境内采购的，和/或大量人员劳务是从中国聘用和动员的。为此，我们已于2020年【】月【】日向贵司发送了不可抗力通知（编号为：）。感谢贵司在目前形势下的理解和支持。

As you know, an epidemics called 2019-nCoV acute respiratory disease (hereinafter referred to as “2019-nCoV Event”)occurs and spreads national-wide in P.R. China and was further identified as a public health emergency of international concern by the World Health Organization (WHO) on January 30, 2020, which has materially affected our execution of the [full nameof the project] (hereinafter referred to as the “Project”), because forthe execution of the Project, the [ ] equipment and [ ] materials are procured and/or lots of labors are employed and mobilized from P.R. China. For theinfluence of the 2019-nCoV Event, we have also sent a notification of force majeure event to you on [month/day, 2020] (Ref. No.: ). Thank you for your understanding and support in such situation.

根据本项目【合同全称】（以下简称“合同”）第【】条的规定，在不可抗力情况下，我们有权获得工期延长和/或成本补偿；同时，根据合同第【】条的规定，对于我们受到的2019新冠疫情的影响，我们应该在知道或本应知道受2019新冠疫情影响之日起【】天内向贵司发出索赔通知，否则将视为我们放弃了索赔权。为此，我们只好向贵司发出这份索赔通知。后续我们将向贵司提交关于2019新冠疫情给我们造成的损失和损害、工期延误以及我们因采取合理措施减轻和消除2019新冠疫情的影响而发生的成本的报告，并附随相关材料。

According to Article [ ] of the [full name of the contract] (hereinafter referred to as the “Contract”) for the Project，we are entitled to be reimbursed with the corresponding extension of time and/or the costs incurred by us; meanwhile, according to Article [ ] of the Contract, we should give you the notice of claim within [ ] days after we become aware or should become aware the influence of the 2019-nCoV Event, otherwise it will be construed as that we have waived the rights of claim. Therefore, we have to send this notification of claim to you. We will subsequently provide a report to you on the loss and damages and the delay caused by，as well as the costs we incur for the mitigation and overcoming the influenceof the 2019-nCoV Event, together with the corresponding particulars.

为了推动本项目尽快完工——这有利于维护贵司利益，也体现了我们合作的诚意，尽管受到了2019新冠疫情的影响，但在上述工期和/或费用补偿尚未解决前我们仍将尽合理的努力应对2019新冠疫情的影响、继续实施本项目。同时，我们在此也保留就上述工期和/或费用进行索赔的权利。

In order to promotion the completion of theProject, which is for your benefits and embodies our good faiths in cooperation, despite the influence of the 2019-nCoV Event, before the reimbursement of the extension of time and/or the costs are settled between us, we will still make our reasonable efforts to deal with the influence of the 2019-nCoV Event and continue to execute the Project. Meanwhile, we hereby retain our rights of claim for the said extension of time and/or costs.
